Terms of Service

These terms apply to this website and to the coaching, classes and programs SENA Fitness provides. Booking a session or using the site means you accept them.

Last updated:

Agreement to these terms

These terms are an agreement between you and SENA Fitness Inc. ("SENA", "we", "us"), a coaching studio based at 510 15 Avenue SW, Calgary, AB T2R 0R2. By using this website, booking a session, or training with us, you agree to them. If you do not agree, please do not use the site or book a session.

Who can book

You must be old enough to enter a binding contract in Alberta to book on your own behalf. [CONFIRM: the minimum age SENA coaches, and whether a parent or guardian must sign for a minor.]

Booking a session

Submitting the booking form is a request, not a confirmed session. A coach contacts you to arrange a time, and the session is confirmed only once we have both agreed on it. We may decline or reschedule a request — for example when no coach is available in your building, or a class is full.

The first consultation is free, with no obligation to continue.

What we provide

SENA provides one-to-one personal training, small-group classes inside partnered residential buildings, online coaching, and time-limited programs. What is included in each format is described on that format's page on this site.

We may change a program's schedule, location or coach where we have to — we will tell you as far in advance as we can.

Fees and payment

Current prices are published on the page for each coaching format. Prices may change; a change never applies to a session or billing period you have already paid for.

[CONFIRM: how and when payment is taken — in advance, monthly, by e-transfer, by card, through which processor. Whether taxes are included in the published prices. Nothing in the codebase answers this.]

Rescheduling, cancellation and missed sessions

[CONFIRM: the actual notice window for rescheduling or cancelling a booked session, and what happens to a session cancelled late or missed entirely. This is the clause clients dispute most often — it has to state a real rule.]

Pausing or ending coaching

Coaching runs month to month. You can pause or cancel it with notice before your next billing date, and we will not bill you for a period that starts after that notice. [CONFIRM: how much notice, and how it should be given — e-mail, in person, either.]

We may end coaching where a client behaves unsafely, breaches a partnered building's rules, or does not pay.

Health, safety and your own responsibility

Training carries risk of injury. Before you start, you confirm that you are medically able to take part, and that you have told your coach about any injury, condition, pregnancy, medication or limitation that could affect your training. Tell your coach immediately if something changes, or if you feel unwell during a session.

SENA is not a medical provider. Nothing your coach tells you, and nothing on this site, is medical advice or a diagnosis. Talk to your physician before starting a new training program.

[CONFIRM: whether clients sign a separate waiver / assumption-of-risk agreement and a PAR-Q before their first session. If they do, say so here and say that the waiver governs where the two documents differ.]

Training inside partnered buildings

Classes and sessions held in a residential building are subject to that building's own rules for its amenity space, and to any access arrangements made with the property. Follow them, and treat the space and its equipment as you would your own. You are responsible for damage you cause.

Access to a building's amenity space is arranged with the property, not granted by SENA, and can be changed or withdrawn by the property.

Conduct

Treat coaches and other clients with respect. We may remove anyone from a session or class for behaviour that is unsafe, harassing or abusive, without a refund.

This website

The text, photographs, logos, program names and design on this site belong to SENA or its licensors. You may read and share the pages; you may not copy them for commercial use, or reproduce a training program we deliver to you for anyone else's use.

Training material we give you — programs, plans, videos — is licensed for your personal use only.

We work to keep the site accurate and available, but we do not promise it will be uninterrupted or error-free. The site may link to other websites; we do not control them and are not responsible for their content.

Privacy

Personal information you send through this site is handled as described in our Privacy Policy.

Limitation of liability

[CONFIRM with counsel: this clause has to be drafted and reviewed for Alberta — a limitation copied from a template can be unenforceable, and an over-broad one can void the sections around it. Leave the section out entirely rather than publishing a placeholder.]

Changes to these terms

We update these terms as SENA changes. The effective date at the top always tells you which version you are reading; continuing to book sessions after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in it. The courts of Alberta have jurisdiction over any dispute.
